TEACLUB USER AGREEMENT
1. PARTIES
This agreement ("Agreement") is entered into between the parties whose names and titles are listed below. Individually, the parties will be referred to as "Turkish Tea Company" or "Cardholder," and collectively as the "Parties."

2. SUBJECT OF THE AGREEMENT
The Cardholder has applied for TEACLUB membership in order to benefit from various advantages offered by Turkish Tea Company. The Parties agree on the terms and conditions related to the Cardholder’s membership and use of TEACLUB as set forth in this Agreement.
3.DEFINITIONS
3.1. Advantages: The benefits offered by the TEACLUB Card to its members include the following,

TEACLUB: A loyalty card, owned exclusively by Turkish Tea Company along with its intellectual and industrial property rights, which allows the Cardholder to make purchases up to the amount previously loaded onto the card by the Cardholder or points loaded by Turkish Tea Company, within the framework of the Terms of Use, and grants the Cardholder various Benefits. This card is assigned to the Cardholder under this Agreement via a card number and features magnetic stripe usage.
3.3. Card Fees: The amounts that may be charged by Turkish Tea Company to the Cardholder in exchange for TEACLUB Card membership and usage,
3.4. Internet Address: The domain name www.turkishteacompany.com.tr , designated by Turkish Tea Company specifically for TEACLUB, as well as any other related and secondary domain name(s) that may be communicated in writing to the Cardholder,
3.5. Mobile Application: The mobile phone application that can be downloaded and used on a mobile phone as specified on the Website and in the Card Kit,
3.6. Card Kit: The kit containing one TEACLUB card assigned with a card number for the exclusive use of the Cardholder, along with accompanying explanations,
3.7. Membership System: The system accessible via the Website and Mobile Application,
3.8. Counters: Authorized individuals and legal entities, as well as TEACLUB electronic kiosks, designated for conducting transactions related to TEACLUB,
3.9. Terms of Use: Refers to the full set of provisions and conditions governing the use of TEACLUB, namely the entire content of this Agreement.
4. DURATION OF THE AGREEMENT
This Agreement shall remain valid from the date of signing until terminated by either Party for any reason.
5. TERMS OF USE
5.1. TEACLUB can only be used by the person whose name, surname, and relevant identification details are written in this Agreement.
5.2. Within the scope of this Agreement, the Cardholder may use TEACLUB to purchase goods and services at member businesses and for purchasing Turkish Tea Company products and services; however, it may not be used for commercial purposes.
5.3. The Cardholder is responsible for all debts arising from the use of the TEACLUB card and acknowledges and declares that the Agreement does not impose any liability on Turkish Tea Company for these debts. Turkish Tea Company is not responsible if the Cardholder cannot complete transactions at member businesses due to insufficient balance on the YES CLUB Card.
5.4. The Parties agree that Turkish Tea Company has the right to unilaterally amend the provisions of this Agreement at any time by announcing changes on the Website and notifying the Cardholder via email; particularly, changes in industry practices, product prices and conditions, and member businesses’ benefits shall be considered justifiable reasons for amending the Agreement by Turkish Tea Company. Such changes will take effect on the thirtieth day following the announcement date. The Cardholder agrees and declares that their use of TEACLUB after the effective date signifies acceptance of the amendments and that accessing the website after the announcement date constitutes awareness of the changes to the Agreement.
6. ADVANTAGES
6.1. The TEACLUB Card provides the Cardholder with Spending Benefits and Membership Advantages that are valid within the framework of the Turkish Tea Company and Member Businesses’ Service Terms.
6.3. Details of the Benefits are specified on the Website. Benefits may be unilaterally changed at any time by Turkish Tea Company, which reserves all rights to modify the Benefits.
6.4. The Parties acknowledge and agree that Turkish Tea Company does not guarantee to provide the Benefits announced on its Website to the Cardholder throughout the term of the Agreement, and the Cardholder cannot make any claims against Turkish Tea Company due to changes in the Benefits.
6.5. Turkish Tea Company is not responsible for disputes between the Cardholder and Member Businesses, and the Cardholder cannot hinder or raise these disputes as obligations against Turkish Tea Company. The Cardholder acknowledges that Member Businesses are solely responsible for defaults or defects in the Benefits or related goods and services, and that any claims arising from such defects should be directed exclusively to the Member Businesses. The Cardholder further agrees that any statements shared by Turkish Tea Company regarding the accuracy, quality, and safety of the Benefits are entirely based on the declarations and commitments of the Member Businesses. Turkish Tea Company holds no liability toward the Cardholder for any breach of the Member Businesses’ own Service Terms. The Parties agree that upon termination of the Agreement for any reason, the Benefits will also automatically cease. In such cases, Member Businesses alone are responsible for any additional rights or opportunities granted to the Cardholder within or outside the scope of their Service Terms, and Turkish Tea Company holds no responsibility.
7. WITHDRAWAL AND CANCELLATION OF MEMBERSHIP
7.1. The Cardholder has the right to withdraw from the TEACLUB Membership Agreement within 30 days from the signing of this Agreement, without providing any reason and without paying any penalty. When the Cardholder wishes to exercise this right of withdrawal, they must notify Turkish Tea Company in writing (by mail, email, or via a notary) through the contact channels provided on Turkish Tea Company’s official website.
7.2. For the right of withdrawal to be valid, it is sufficient that the notification reaches Turkish Tea Company within the legal 30-day period.
7.3. Upon exercising the right of withdrawal, any Benefits and balance existing on the TEACLUB card shall automatically be canceled and removed from the account as of the termination date.
8. TERMINATION OF THE AGREEMENT
8.1. The Parties agree and declare that in case the Cardholder violates any provision of the Agreement, Turkish Tea Company may unilaterally terminate the Agreement without any prior notice or compensation, by informing the Cardholder via the email address or the mobile phone number provided in the membership agreement form through a text message. In the event of termination under this provision, only the Benefits and balance existing on the TEACLUB card as of the termination date shall automatically be canceled and removed from the account.
8.2. The Cardholder may terminate this Agreement at any time. In such a case, the Cardholder must notify Turkish Tea Company at least one (1) month in advance by sending a termination notice via email to the email address found on Turkish Tea Company’s website. As of the termination date, all accrued Card Fees, Benefit Fees, or other payments on the Cardholder’s account shall be borne by the Cardholder.
9. OTHER PROVISIONS
9.1. The Cardholder expressly consents, declares, and undertakes that all personal data, including sensitive personal data, shared during registration to the TEACLUB and Turkish Tea Company Membership System or in the general use of the system, shall be processed, stored, and, when necessary, shared with business partners by Turkish Tea Company within the scope of the fulfillment and continuation of this Agreement, in accordance with the Law No. 6698 on the Protection of Personal Data (KVKK) and relevant secondary legislation.
9.2. All personal data collected by Turkish Tea Company regarding the Cardholder may be securely retained for a maximum period of ten years for legal or commercial reasons in accordance with the relevant provisions of the Turkish Code of Obligations and the legal obligations stipulated in the legislation.
After this period, the said data shall be deleted, destroyed, or anonymized in accordance with Turkish Tea Company’s Personal Data Retention and Destruction Policy.
9.3. Pursuant to Article 11 of the Personal Data Protection Law (KVKK), the Cardholder has the right to;
Individuals have the right to learn whether their personal data is being processed, to request information regarding this processing if it is, to learn the purpose of the processing and the duration of its use, and to request the correction, deletion, or destruction of their data.
The Cardholder may submit these requests through the communication channels provided on Turkish Tea Company’s official website.
9.4. The Cardholder hereby consents, through this agreement, to receive electronic commercial communications regarding the goods and services subject to the Agreement for advertising and informational purposes during the term of the Agreement, via Turkish Tea Company and companies with which Turkish Tea Company has partnerships or cooperates through various projects. The Cardholder may withdraw their consent to receive electronic commercial communications at any time through the Website and authorized authorities. Other provisions of the Agreement remain unaffected.
9.5. The Parties agree that in all transactions under this Agreement, the books and records of Turkish Tea Company, as well as its computer records, electronic records, server data, data stored on permanent storage devices, telephone and voice recordings, and other similar documents shall constitute conclusive and exclusive evidence. Documents and records presented by the Cardholder shall only be considered valid if consistent with the documents and records of Turkish Tea Company; this provision shall be regarded as a written evidence agreement.
9.6. This Agreement is governed by Turkish law.
In case of any disputes arising from this Agreement, the courts and enforcement offices of Istanbul (Çağlayan) Central shall have jurisdiction.
9.7. The Cardholder declares that they have read, understood, and accepted all provisions published on the official website of Turkish Tea Company before signing this Agreement. Furthermore, the Cardholder acknowledges and undertakes that the e-mail address provided during registration to the TEACLUB Membership System is actively used by them, accurate, and valid, and that all notifications can be sent to this address.
10. EFFECTIVE DATE
10.1. The Agreement has been mutually agreed upon by the Parties and consists of 10 (ten) main articles in a single copy, accepted by the free will of the Parties and signed on the date it was approved via the website. A copy of the Agreement has been automatically sent to the Cardholder’s email address.

6. ADVANTAGES
6.1. The TEACLUB Card provides the Cardholder with Spending Benefits and Membership Advantages that are valid within the framework of the Turkish Tea Company and Member Businesses’ Service Terms.
- (a) Spending Benefit: Spending made with TEACLUB at Turkish Tea Company and Member Businesses will grant the Cardholder a discount on the spending amount or a certain number of points to be loaded onto the YES CLUB Card by Turkish Tea Company based on the spending amount. The loaded points will provide a discount determined by Turkish Tea Company on future purchases.
- (b) Membership Advantage: The TEACLUB Card grants Cardholders certain rights such as free or discounted entry to Turkish Tea Company events and related Member Businesses for a specified period.
6.3. Details of the Benefits are specified on the Website. Benefits may be unilaterally changed at any time by Turkish Tea Company, which reserves all rights to modify the Benefits.
